Hon. Justice Kiryabwire Named International Mediator

ENGLAND - Court of Appeal/Constitutional Justice, Hon. Geoffrey Kiryabwire, has been appointed a mediator at the Insolvency International College of Mediation based in England. He is the only African mediator on the 14-man panel of mediators from different countries.

INSOL\r\nInternational College of Mediation is the first of its kind in the world\r\nbringing on board an option to mediate insolvency matters.
\r\n\r\n
Hon.\r\nJustice Kiryabwire and team are to mediate in commercial disputes and also make\r\nthe concerned parties realize the need to mediate bearing in mind of costs and\r\nconsequences of delay in prosecuting a case to its logical conclusion.
\r\n\r\n
According\r\nto a statement from Insolvency International, there is need to appoint\r\ninternational mediators to help in the reduction of huge caseload currently\r\nfacing courts globally, leading to delays in hearing the case that\r\nwould in the end affect the cash flow of the litigating business\r\ncompanies.
\r\n\r\n
Insolvency\r\nproceedings involve areas of uncertainty regarding rights, quantum, the\r\nefficacy or propriety of a proposed course of action, which may be suitable for\r\nan independent view of a mediator.
\r\n\r\n
Hon.\r\nJustice Kiryabwire said he had been attending meetings for INSOL for the last\r\nfour years and was honored to be named as a panelist.
\r\n\r\n
"Promoting\r\nmediation in insolvency situations is a breakthrough. Instead of shutting\r\noperations, insolvency mediation will be working at a win-win situation for\r\nboth financiers and borrowers,” he said.
\r\n\r\n
The\r\nother mediators on the panel include; Hon. Justices Glen Davis QC and Ian R C\r\nKawaley (England), James M Farley and Frank C Newbould (Canada), Birgit Sambeth\r\nGlasner (Swiss Land), and Allan L Gropper, Robert S Hertzberg and James M Peck\r\n(USA). Others are; Dr Christopher Paulus (German), Felicity R Toube QC\r\n(England/USA), and Wisit Wisitsora-At (Thailand), Jonathan Harris (Hong Kong).

The panelists\r\nare all considered leaders in insolvency cases in their respective capacities.

Who is Hon. Justice Kiryabwire?
\r\n\r\n
He\r\nhas been active in developing mediation and other forms of ADR in Uganda both\r\nas a judge and prior as a corporate lawyer. He is a Fellow of the Uganda\r\nArbitration Association and an Associate of the Uganda Insurance Institute.
\r\n\r\n
Hon.\r\nJustice Kiryabwire was earlier this year appointed a Judge of East African\r\nCourt of Justice (Appellate Division).

He\r\nhas taught Alternative Dispute Resolution (ADR) to students of the Uganda Bar\r\nat the Law Development Centre and International Law Institute-African Centre\r\nfor Legal Excellency.
\r\n\r\n
He\r\nauthored a number of papers on ADR and is a contributor to the book titled\r\nArbitrator in Africa. Before his appointment to the Ugandan Court of Appeal,\r\nHon. Justice Kiryabwire headed the Kampala-based High Court’s Commercial\r\nDivision.
