Court of Appeal to Hear 25 Criminal Appeals in Kampala
21st, July 2024
The Court of Appeal is set to hear 25 criminal appeals in Kampala, starting July 22and concluding on July 24, 2024.
The three-day session will be presided over by Justice Fredrick Martin Stephen Egonda-Ntende, Justice Cheborion Barishaki, and Justice Dr. Asa Mugenyi.
The cause list, signed by the Court's Deputy Registrar, HW Lillian Bucyana, indicates that of the 25 appeals to be handled, Murder and Defilement constitute the majority of cases with six appeals each. Robbery follows with four appeals, Abuse of office with three, and Rape with two.
Additionally, the cause list indicates that the Justices will also handle appeals on Giving False Information (one), Trespass and Malicious Damage (one, False Pretense(one), and Grievous Harm (one).
Two appellants are seeking to overturn life sentences, one for Murder and the other for Aggravated Robbery.
The State is appealing in two cases. In one, it is appealing against an acquittal for Abuse of Office involving Eng. Kakiiza Robert, a former Principal Civil Engineer at the Ministry of Works and Transport.
In the other, the State is appealing against a stay of proceedings in a Trespass and Malicious Damage case against Land Dealer Kamoga Muhammad of Kamoga Property Consultants.
The appeals were filed between 2014 and 2023.
According to HW Bucyana, the general policy on cause listing is "first in, first out." However, there are exceptions to this rule. Notably, the Court of Appeal prioritizes appeals from the Anti-Corruption Division, regardless of the age of the appeal, once the lower court record is available, such a case is cause-listed.
